According to Texas Penal Code Section 32.51, the types of charges are as follows:
- Fewer than 5 items of information: State jail felony
- Between 5 and 10 items: Felony in the 3rd degree
- 10 to 49 items: Felony in the 2nd degree
- 50 or more items: Felony in the 1st degree
