Published personal injury appeal
A second chance for injured construction workers.
Houston attorney Korey Huff helped injured construction workers win a published appeal that restored their negligence claims.
Read the case story
Two construction workers were injured when a scaffold collapsed. After the trial court dismissed their claims, Korey A. Huff was part of the legal team representing them on appeal in Abarca v. Scott Morgan Residential, Inc.
On September 24, 2009, Houston’s First Court of Appeals reversed the dismissal of their negligence claims and returned the case to the trial court. Under Texas Chapter 95, the court found factual questions about control over the work and actual knowledge of the danger with a failure to adequately warn.
The ruling allowed those negligence claims to proceed. It did not award damages; the dismissal of contract and negligence-per-se claims remained in place.

QUESTIONS CLIENTS ASK
Personal injury and criminal defense questions
Choosing your lawyer
Are there any Black attorneys in Houston, Texas?
Yes. Korey Huff is a Black attorney in Houston and has been licensed in Texas since 2005. The Huff Law Firm handles personal injury cases, including car and truck accidents, as well as criminal defense. If you want to discuss your situation and see whether the firm is a good fit, all consultations are free.
How to find a Black attorney?
Start with local attorney profiles and referrals, then check the lawyer's license through the State Bar of Texas. Ask about experience with your type of case, communication, and fees. If you are looking for a Black attorney in Houston for personal injury or criminal defense, Korey Huff offers free consultations through The Huff Law Firm.
What should I ask before hiring a Houston lawyer?
Ask about experience with cases like yours, who will handle the work, how you will receive updates, and how fees and expenses are charged. You should feel comfortable asking questions and discussing difficult facts. A consultation helps you decide whether the lawyer fits your needs.
What should I bring to a free consultation?
Bring a short timeline, your questions, and any relevant documents you already have. Depending on the case, these may include accident reports, medical records, insurance letters, or court papers. Ask the office what would be helpful when scheduling. All consultations at The Huff Law Firm are free.
Car accidents and insurance
Is it worth hiring an attorney for a car accident?
It can be, especially when injuries, disputed responsibility, or an insurance settlement leave you unsure what to do next. A Houston car accident attorney can help you assess the evidence, your losses, and the costs of pursuing a claim. The Huff Law Firm offers a free consultation so you can discuss your options before deciding whether to hire an attorney.
What should I do after a car accident in Houston?
Prioritize safety and medical attention, and call police if someone is injured. When safe, exchange insurance information, photograph the scene, and get witness contact details. Report the crash to your insurer and keep records of treatment and expenses. If you have questions about an injury claim, a consultation can help you understand the next steps.
When should you get an accident attorney?
Consider speaking with an attorney early if you were injured, fault is disputed, or you are being asked to sign a settlement release. Early review can help you organize evidence and understand your options before making decisions. The Huff Law Firm offers free consultations for car, truck, motorcycle, and rideshare accidents.
What if the driver who hit me does not have insurance?
Your own policy may provide options, including uninsured motorist, collision, medical payments, or personal injury protection coverage. Each covers different losses and has its own conditions and limits. Bring your policy and claim documents to a consultation so the available coverage and potential injury claim can be reviewed.
Who pays for injuries in an Uber or Lyft accident?
It depends on responsibility for the crash and which insurance policies apply. Rideshare coverage can change with the driver's activity, and personal auto policies may exclude rideshare use. The Huff Law Firm handles rideshare accident cases and can review the circumstances, trip information, and available coverage during a free consultation.
How much will I get from a $50,000 settlement?
A $50,000 settlement is the gross amount; your take-home amount depends on agreed attorney fees, case expenses, and any medical bills, liens, or reimbursement claims payable from the settlement. No reliable net estimate can be given without those details. Ask for an itemized breakdown showing deductions and the amount payable to you.
Should I accept the insurance company's settlement offer?
Understand what the offer pays for and what rights you would release before accepting. An injury settlement usually resolves the claim against the released party, so the effect of your injuries matters. A lawyer can review the offer and explain your options, but the decision whether to settle belongs to you.
Personal injury claims
What not to say to an injury lawyer?
Avoid guessing, exaggerating, or leaving out facts because you think they might hurt your case. Tell your injury lawyer what you remember, what you are unsure about, and whether you had earlier injuries or treatment. Honest answers help the lawyer evaluate your claim. You can discuss your concerns during a free consultation with The Huff Law Firm.
What are the chances of winning a personal injury lawsuit?
There is no reliable percentage for your case without reviewing the facts. The evidence of who was responsible and how the injury affected you matters, and no lawyer can guarantee a result. Many personal injury cases settle before trial. A free consultation with The Huff Law Firm can help you understand the strengths, questions, and possible next steps in your claim.
Who gets paid first in a personal injury settlement?
There is no single payment order for every settlement. Valid liens and reimbursement rights, the fee agreement, and applicable law affect distribution. Disputed amounts may need to remain in trust while the dispute is resolved. Ask your lawyer for an itemized explanation of payments, any amounts held, and the funds available to you.
How much does it cost to hire a personal injury lawyer?
Your case review is free. If we accept your personal injury case and don’t recover money for you, you owe our firm no attorney fees and nothing for the case expenses we advanced. If we recover money, attorney fees and case expenses are handled according to your written agreement.
How long do I have to file a personal injury lawsuit in Texas?
Texas law generally sets a two-year filing period for personal injury lawsuits, measured from when the claim accrues. Exceptions and different claim rules can affect the deadline. Do not assume the same date applies to every case; an attorney can review the facts and identify the deadlines that matter.
Who can bring a wrongful death claim in Texas?
Texas law allows a surviving spouse, children, and parents to bring a wrongful death action for the benefit of those family members. The circumstances and family relationships need individual review. The Huff Law Firm handles wrongful death matters and offers a free consultation to discuss eligibility and possible next steps.
How do I know whether I have a medical malpractice claim?
An unexpected or disappointing medical outcome does not by itself establish malpractice. The question is whether care fell below the applicable standard and caused harm. A review starts with what happened, the treatment provided, and the resulting injuries. The Huff Law Firm offers free consultations about potential medical malpractice claims.
Criminal defense
How much does a criminal lawyer cost in Houston?
There is no single price. Criminal defense fees depend on the charge, the complexity of the case, and the work required. Ask what the quoted fee covers, whether trial is included, and what additional expenses may apply. The Huff Law Firm offers free consultations so you can discuss your charge and the proposed fees before deciding how to proceed.
Do I need a lawyer for a misdemeanor charge?
A misdemeanor can still carry serious consequences, including possible fines, jail time, and effects beyond the courtroom. A criminal defense lawyer can explain the charge, evaluate the evidence, and discuss the consequences of a plea or trial. The Huff Law Firm offers free consultations about criminal defense matters.
Can I ask for a lawyer before answering police questions?
Yes. You can ask to speak with an attorney before answering questions about a suspected crime. After arrest, you have the right to remain silent and to have a lawyer present during questioning. A criminal defense attorney can explain how those rights apply to your situation.
Who are some good Black criminal defense attorneys in Houston?
Korey Huff is a Black criminal defense attorney in Houston who has been licensed in Texas since 2005. Whether an attorney is a good fit depends on experience with your charge, communication, and the proposed fees. The Huff Law Firm offers free consultations so you can ask questions and discuss your situation.
Can a criminal case be dismissed?
Sometimes. Dismissal may be possible when the evidence is insufficient or important evidence cannot legally be used, among other reasons. The available options depend on the facts and court proceedings. A defense lawyer can evaluate potential grounds and discuss a strategy, but hiring a lawyer does not guarantee dismissal.
What if I cannot afford a criminal defense lawyer?
If you cannot afford counsel and face a charge that could result in jail or prison, you may qualify for a court-appointed lawyer. Ask the court for the application and any required financial questionnaire. Appointment depends on eligibility; The Huff Law Firm's free consultation is separate from the court's appointment process.
