The DWI Pre-Trial Intervention (DWI PTI) Program is a one-year voluntary supervision program available through the Harris County District Attorney’s Office to first-time offenders charged with a Class B Misdemeanor DWI or BWI. Upon successful completion of the program, participants are eligible to have their DWI case dismissed, avoid DPS surcharges, and apply for expunction 2 years after dismissal.
Basic program components include:
- Evaluation and assessment
- Use of alcohol-monitoring devices
- Monthly supervision
- Education and treatment
- Community service
Who Can Apply?
First-Time Class B Misdemeanor DWI/BWI Offenders with BAC level of 0.149 or below.
Eligible Defendants
- with Class C convictions are allowed to apply.
- Under 21 years of age may apply.
- Juvenile history is reviewed on a case-by-case basis.
- Class B DWI/DWI cases resulting from drugs (prescription or illicit) or a combination of drugs and alcohol are allowed.
- Must obtain a valid driver’s license at the time of the offense.
- Must provide proof of insurance for the vehicle Defendant was operating on the arrest date.
- Must be a U.S. Citizen, a Lawful Permanent Resident (LPR), or possess an Employment Authorization (Work Permits) or Deferred Action for Childhood Arrival (DACA) card or possess sufficient identifying information and community contacts prior to the arrest.
- Must be a Harris County resident or from an adjacent county (all conditions must be met in Harris County, Texas).
- Only the following misdemeanor companion cases are allowed:
- POM
- PCS
- PDD
- All Defendants must be employed or attending school.
Ineligible Defendants
- Defendants with previous arrest, Pre-Trial Intervention, deferred adjudication, probation, or conviction for an offense other than a Class C misdemeanor whether in county or out-of-county.
When Should I Apply?
- The DA’s Office should be notified within 60 days from your arraignment. Therefore, it is important to contact an experienced and qualified attorney as soon as possible.
Participation
If you are accepted into the program, the charges against you are placed on hold for the duration of the program. During this year-long program, you could be expected to attend classes/counseling, urine testing, and monitoring. Adherence to the stipulations of your agreement is very important. Upon successful completion of the PTI DWI Program, your case is eligible for dismissal and may be expunged from your record 2-years after dismissal.
