A driver may have insurance that is insufficient for the covered losses. Whether UIM benefits are available depends on the policy, responsibility, damages, applicable credits, and other requirements.

Details that deserve a closer look
Keep every coverage conversation in its own lane.
One collision can generate several claim numbers with different insurers or departments. Make a short list showing who opened each claim, which coverage they identified, and what documents they requested. A vehicle-repair update does not necessarily answer the questions about your injury claim. Ask for unclear positions in writing.
Use the policy documents that applied on the date of the crash. A current insurance card or renewal notice may reflect later changes. Keep the declarations page, endorsements, and any notices from that period. If the insurer sends only part of the policy, note what is missing instead of filling in the gaps from memory.

What is the difference between uninsured and underinsured motorist coverage?
Uninsured motorist coverage may apply when a responsible driver lacks insurance. Underinsured coverage may apply when that driver’s insurance is insufficient. Your policy and the facts determine whether benefits are available. The names alone do not establish payment.
How do I know whether I have UM/UIM coverage?
Start with your declarations page, then review the full policy and any selection or rejection documents. Texas insurers generally must offer this coverage, and it can be rejected in writing. Bring the documents instead of relying only on what you remember buying.
Can I make a UM/UIM claim with my own insurance company?
That is generally where this coverage is found, but the policy must apply to you and the accident. You may still need to establish the other driver’s responsibility and your covered losses. Your insurer’s involvement does not remove the need to document the claim.
What if the other driver left the scene?
Report what happened and preserve available evidence. A hit-and-run claim can have specific coverage and proof requirements, including issues involving contact between vehicles. Have the actual policy and facts reviewed before assuming coverage exists or does not exist.
Should I accept the other driver’s policy limits first?
Get advice on the proposed settlement and your own policy requirements before signing. Consent, notice, releases, and other rights may matter. Bring the offer and full policy so the steps can be considered together.
Is UIM the same as personal injury protection?
No. Personal injury protection, often called PIP, is a different type of coverage with its own terms. UM/UIM, PIP, medical payments, and health insurance should not be treated as interchangeable. We can review which questions your documents raise.
The insurer says I have no claim. Is that the final answer?
Ask for the position in writing and keep the policy. A case review can compare the stated reason with the documents and the facts. It does not guarantee the decision will change, but it gives us something concrete to examine.
How do I get a UM/UIM case review in Houston?

What if I changed insurance companies after the wreck?
Keep information for the insurer and policy in place when the crash occurred, along with the dates of any later changes. Tell the reviewing attorney which company received notice and what it said. Changing companies does not, by itself, explain the coverage or obligations connected to an earlier event.
Can a passenger ask about coverage under more than one policy?
Yes, it is worth identifying potentially relevant policies, including the vehicle’s policy and your own documents. That does not mean each policy applies or that limits can simply be added together. Who qualifies as an insured, exclusions, and policy coordination all need careful review.
My car has been repaired. Why are injury questions still coming?
Property damage and bodily injury can involve different coverage questions, documents, and claim handling. Keep the repair payment and any release you signed so its scope can be checked. Do not assume payment for one part of the loss resolves every issue or confirms payment for another.
