Can I call if I was hit while walking outside a crosswalk?
Yes. Tell us where you were, the traffic conditions and what the driver did. Crossing location can affect responsibility, but it does not replace a review of all the facts. Avoid deciding the legal outcome based on one detail alone.
Do bicyclists have the same rights as drivers in Texas?
Generally, bicyclists have the rights and duties that apply to vehicle drivers, with bicycle-specific rules and exceptions. Traffic signals, lane position and travel direction may matter. The rules that apply to your route should be considered alongside the evidence.
What if the driver says I caused the collision?
An accusation is something to investigate. In claims governed by Texas proportionate responsibility rules, being more than 50% responsible bars recovery; responsibility of 50% or less reduces recoverable damages by that percentage. Photos, witnesses and other evidence can help address disputed accounts.
What should I do if the driver leaves the scene?
Prioritize safety, call for emergency help when needed and report the collision to police. Keep any vehicle description, partial plate or witness information you already have. Do not chase the driver. Let us know what the investigating agency has provided.
Should I keep my damaged bike and helmet?
Yes, if you can safely preserve them. Their condition may help document the impact. Keep original photos and purchase or repair information as well. Ask about evidence preservation before repairing, discarding or transferring items connected to the collision.
Can I ask about a claim while I am still receiving treatment?
Yes. Tell us what has been diagnosed and what remains uncertain. Follow your treating providers’ recommendations. You do not need to finish treatment before discussing evidence or deadlines, and you should not guess about future medical needs.
What compensation might be available?

How long do I have to file a lawsuit?
