Who can bring a wrongful death claim in Texas?
Texas law identifies a surviving spouse, children, and parents as wrongful death beneficiaries. The circumstances and any estate representative’s role still need review. Tell me your relationship to the person who died so we can address the right questions.
Is a wrongful death claim the same as a survival claim?
No. A wrongful death claim concerns eligible family members’ losses. A survival claim preserves a claim the deceased person could have pursued, with estate-related issues to address. The two may arise from the same event but should not be treated as interchangeable.
Can I call if no estate has been opened?
Yes. Tell us what has and has not been done. Whether an estate appointment is needed depends on the claims and circumstances. You do not need to solve that question before requesting a case review.
Does a fatal accident automatically create a wrongful death case?
No. We need facts supporting legal responsibility for the death. The records, witnesses, circumstances, and applicable law matter. A case review helps identify the questions that need investigation.
Does a criminal investigation prevent a civil claim?
