Details that matter
Preserve your car accident evidence.
Get needed medical care and follow your providers’ recommendations. When it is safe, keep photos of the scene and vehicles, witness contact details, the crash report number and the insurance information you receive. Save original dashcam files and the time before and after the impact. Do not put yourself in traffic or recreate the crash to collect evidence.
Keep a simple record of each insurer’s name, claim number, adjuster and requests. Notify your own insurer promptly and ask about your obligations under the policy. Requests from your own insurer and the other driver’s insurer may raise different issues. A careful review starts with knowing who is asking and what they want. If you need guidance through these steps, consulting a Houston car accident attorney may help protect your interests.
Understand the process
Building your car accident claim.
A car accident claim may involve identifying responsible parties, preserving records, reviewing coverage and documenting the connection between the collision and your losses. The work changes when a commercial vehicle, paid ride or uninsured driver is involved. A company logo, citation or insurance card rarely answers every question by itself, and sometimes seeking advice from a Houston car accident attorney is necessary.
Some matters can be resolved through a negotiated settlement. Others may require a lawsuit, formal discovery or a trial to resolve disputed issues. An initial case review is the place to ask what the evidence currently shows, which issues need investigation and what the proposed representation would include. Understand the fee and expense agreement before deciding. Also, a Houston car accident attorney can walk you through what to expect.
Look beyond the first bill
Car accident losses: medical bills and missed work.
Keep medical bills, insurance benefit statements and payment receipts without assuming they all describe the same amount. Work restrictions, payroll records and documentation of time away from work can help explain economic losses. For someone who works independently, business records and a careful explanation of canceled work may be important. If you need legal support about these concerns, a Houston car accident attorney can provide specific advice.
Depending on the facts and law, an injury claim may also address pain, impairment and other effects on daily life. Future care or reduced earning ability needs supporting evidence. Write down concrete changes in your own words. A case evaluation should explain the support for the claimed losses and any issues that could limit recovery.
Car wreck questions with Korey The Lawyer
Car accident questions.
Let’s talk about them.
Insurance calling? An offer on the table? Start here, then tell me what happened.
What should I do after a car accident?
Stop, check for injuries, and call 911 if anyone is hurt or in immediate danger. If no one is injured and your vehicle can be driven safely, move out of traffic. When safe, exchange driver and insurance information, photograph the vehicles and scene, and get witnesses’ contact information. Notify your own insurer promptly and keep the crash report number, medical records, and bills.
What should I do after a car accident that was not my fault?
Report the crash to the other driver’s insurance company and notify your own insurer, even if you believe the other driver caused it. Save photos, witness details, the crash report if available, and each insurer’s claim number. The other insurer may dispute responsibility or coverage; if it refuses payment, ask for a detailed explanation in writing. A free consultation can help you understand your options if you were injured or the claim is disputed.
Should I get a lawyer for a car accident?
Consider speaking with a lawyer if you were injured, responsibility is disputed, the insurer refuses payment, or you do not understand an offer or release. A consultation can help you understand your claim and decide whether representation would help. The Huff Law Firm offers free consultations; before hiring the firm, ask who will handle your case and how attorney’s fees and case expenses work.
Someone rear-ended me. What should I do?
Check for injuries, call for emergency help when needed, and exchange driver and insurance information. When safe, photograph damage to every involved vehicle and the surrounding roadway, collect witness information, and preserve any dashcam recording. Save evidence even if the cause of the crash seems obvious, and notify your insurer. If you were injured or have questions about an insurance offer, contact The Huff Law Firm for a free consultation.
I was injured in a car accident that was not my fault. What should I do?
Get medical care for your injuries and keep treatment records, bills, receipts, and documentation of missed work. Report the injuries when you notify the insurers, and ask what coverage may apply. Depending on your policy and the circumstances, personal injury protection, medical payments, or uninsured/underinsured motorist coverage may help with eligible losses. Bring your records and any settlement paperwork to a free consultation so the firm can review your options.
Do I have a case after a car wreck?
Tell me what happened. We need to look at how the wreck happened, who may be responsible, the injuries, and the evidence. A free case review is a place to start. You do not have to figure it all out before you call.
Is a car accident attorney the same as a personal injury lawyer?
Car accident injury cases are one part of personal injury law. People use both terms when looking for help after a wreck. At The Huff Law Firm, we handle personal injury claims involving car accidents, truck crashes, rideshare accidents, and motorcycle wrecks.
How do I choose a Houston car accident lawyer?
Ask who will handle your case, how the firm will keep you informed, and how fees and expenses work. Ask about experience with wrecks like yours. Read the written agreement and make sure your questions are answered before you sign.
Insurance is calling. What should I do?
First, find out which insurance company is calling and what they want. A request from your own insurer can come with different obligations than a request from the other driver’s insurer. Do not ignore your policy’s reporting requirements. If you are being asked for a recorded statement, records, or a signature, call and ask questions before deciding what to do.
Should I sign the settlement offer?
Before you sign or settle, talk with me. As a Houston car accident attorney, I can help you understand what the offer covers and what rights the release could give up. Your treatment, expenses, and other accident-related losses deserve a closer look. An offer is a starting point for questions, not a reason to rush.
What is my car-wreck claim worth?
I need the facts before I can give you a meaningful answer. The injuries, medical expenses, missed income, responsibility for the crash, and available coverage all matter. A number from someone else’s case is not a promise about yours.
What about medical bills and missed work?
Tell us about both. Keep the bills, treatment records, receipts, and information about time you missed from work. These help show how the wreck affected your life. What may be recoverable depends on the facts and the law that applies to your claim. By working with an experienced Houston car accident attorney, you can understand your options more clearly.
Can I call before I have the crash report?
Yes. Call with what you know. If you have the report number, photos, insurance information, or letters from an adjuster, have them nearby. If you do not, we can talk about what information is needed next.
Do you handle 18-wheeler and delivery-truck wrecks?
Yes. The Huff Law Firm handles car wrecks and crashes involving 18-wheelers, commercial vehicles, and delivery trucks. Tell us where it happened and which vehicles were involved so we can begin reviewing the facts.
What about an Uber or Lyft accident?
We handle rideshare accident cases too. Tell us whether you were a passenger, a driver, or in another vehicle. The driver’s activity at the time of the crash can affect which insurance coverage may apply. As a Houston car accident attorney, I am familiar with rideshare incidents and how to approach these unique situations.
Do you handle motorcycle crashes and serious injury cases?
Yes. Our accident practice includes motorcycle crashes, serious injury, and wrongful death matters. Call the firm to talk about the circumstances and whether we can help.
What if the other driver has no insurance?
Bring your own insurance information to the case review. Uninsured or underinsured motorist coverage may be relevant, and other options depend on the facts. Do not assume there is no path forward before the available coverage has been reviewed. If you need guidance, a Houston car accident attorney can advise you on the possible next steps.
How much does it cost to talk with you?
The initial case review is free. We handle car accident injury cases on a contingency fee basis. Ask us to explain the attorney’s fee and case expenses in writing before you hire the firm. You should understand the agreement.
Do I have to live in Houston?
No. Our office is in Houston, and we serve injured Texans, including clients in San Antonio and Killeen. Those cities are service areas, not additional office locations. Tell us where the wreck happened when you call.
Who is Korey The Lawyer?
I’m Attorney Korey A. Huff, founder of The Huff Law Firm, LLC. You may know me as Korey The Lawyer or @koreythelawyer. We are based in Houston. Car wreck in Texas? Hit Me Up.
Where is your office, and how do I reach you?
The Huff Law Firm, LLC is at 1 Riverway Dr., Suite 1700, Houston, TX 77056. Call 1-877-HIT-MEUP!®️ (1-877-448-6387), or request a free case review on this page.
What should I put in the case-review form?
Start with your name, a way to reach you, and a brief, non-confidential message. Please do not put medical records, Social Security numbers, or other sensitive details in the form. Contacting us does not create an attorney-client relationship. We can discuss the next step when the firm follows up.
How long do I have to file a Texas car accident lawsuit?
Texas generally allows two years after a personal injury claim accrues to file a lawsuit. Exceptions can change the deadline, and claims involving government entities can have earlier notice requirements. Do not assume insurance negotiations protect the filing deadline. Have the dates reviewed promptly.
Can I recover compensation if the crash was partly my fault?
Possibly. Under Texas proportionate responsibility rules, responsibility above 50% bars recovery. At 50% or less, recoverable damages are reduced by your share. A disagreement about fault calls for evidence, including the scene, witness accounts and available recordings.
What if I was injured as a passenger?
Tell us which vehicle you were in, who was driving and whether it was a paid ride or work trip. Responsibility may involve one driver or more than one. Relevant policies and your relationship to the parties need review. Do not assume a passenger must pursue the same claim as the driver.
The crash report has a mistake. What should I do?
Keep a complete copy and identify the specific statement you believe is wrong. Save the records, photos or witness details that may explain the discrepancy. Ask the investigating agency about its correction process. A report is one piece of the evidence, and a disagreement should be addressed factually.
Does settling vehicle damage also settle my injury claim?
Read the actual agreement. A repair or total-loss payment may address different issues from bodily injury, but the scope of any release matters. Keep every page of the offer and release. Before signing, understand which people and claims the language covers.
Why do some car accident cases take longer than others?
Timing can depend on medical information, disputed responsibility, the number of parties, available insurance and whether a lawsuit becomes necessary. A quick offer is not the same as a fully evaluated claim. Ask what remains unresolved and what information would help move the review forward.
