The State Long-Term Care Ombudsman can help with residents’ rights and care concerns. A call to a law firm does not replace emergency care or a report to the appropriate agency.

A regulatory complaint and a civil injury claim follow different processes. A facility finding does not automatically establish every part of a lawsuit, and a pending complaint should not be assumed to pause a legal deadline. Does a bedsore or fall automatically prove nursing home neglect?

No. The review must consider the resident’s condition, risks, required care, records and the cause of the injury. A poor outcome alone is not proof of negligence. Tell us when the problem was noticed, what was reported and how the facility responded.

What should I do if my loved one may be in immediate danger?

Call 911 for an emergency or immediate danger and seek appropriate medical help. Do not wait for a case review. For nursing facility abuse or neglect concerns, HHS Complaint and Incident Intake is available at 1-800-458-9858. Keep any report reference information.

Can I call on behalf of my parent or another relative?

Yes. You can ask questions and share basic information about the concern. Making decisions, obtaining private records or bringing a claim for someone else may require legal authority. Bring any power of attorney, guardianship or other relevant documents for review.

What records can help with a nursing home claim?

Care plans, assessments, medication records, treatment records and hospital discharge papers may be relevant. Family messages and dated observations can also help. Start with documents you lawfully possess; access to additional records should be handled through proper authorization and procedures.

Are nursing home cases treated like ordinary injury claims?

Many involve a health care liability claim under Chapter 74 of the Texas Civil Practice and Remedies Code. Whether that chapter applies depends on the substance of the allegations. Special notice, expert-report and deadline rules can apply, so the classification needs early attention.

Will a medical expert be needed?

A health care liability claim generally requires timely service of a qualifying expert report addressing the applicable standard of care, the alleged failure and causation. Exceptions, extensions and procedural rules can affect the requirement. The report and litigation deadlines must be evaluated for the particular case.

How long do I have to take legal action?

Do not rely on a general two-year-from-discovery rule. Chapter 74 has specific limitations provisions and notice rules, and the relevant dates and exceptions require review. Contact the firm promptly even if a facility or agency is still investigating your concern.

Is compensation unlimited in a nursing home case?

No blanket statement about unlimited recovery is appropriate. Texas health care liability law can limit noneconomic damages, and other restrictions may apply. The type of claim, defendants and supported losses matter. A past settlement does not establish the value of another person’s case.

What if I already signed facility admission paperwork?

Keep a complete copy, including any arbitration agreement and documents identifying who signed. Do not assume the paperwork ends the matter or has no effect. The terms, signatures, authority and surrounding circumstances need to be reviewed before drawing conclusions.
