A closer look at your claim

Begin with the people and the facts.

What happened?

The investigation may involve crash or incident records, witnesses, video, medical records, and the conduct of the people or businesses involved. A death alone does not establish another party’s legal responsibility.

Who may bring a claim?

Texas wrongful death law identifies certain family members who may benefit from a claim. An estate may have a separate survival claim. These are different questions, and we need to understand the relationships and any existing appointment.

What needs attention now?

Evidence preservation, insurance communications, and legal deadlines may need attention even while a family is grieving. Tell us about any papers you have received. You do not need to sign a release just to ask questions about it.

Houston roots. Texas reach.

Start with the information available to your family.

Have these items nearby if you already have them. A missing document should not stop you from calling:

  • Your relationship to the person who died
  • Date, location, and available incident or crash information
  • Names of surviving family members
  • Any estate appointment or related court papers
  • Letters from insurance companies or proposed settlements
  • Known witnesses and records that may explain what happened

Details that deserve a closer look

Keep the details together. Your family does not need perfect answers today.

After a fatal crash, information may arrive through investigators, hospitals, insurers, and relatives. Keep a simple record of who contacted your family, when, and what they said. Save original letters and emails. When an account is secondhand, note who supplied it instead of treating it as a confirmed finding.

A person’s contribution to a family is not captured by one paycheck or one bill. When you are ready, gather existing records that help explain work, household responsibilities, and support. There is no need to force those memories into legal language or assign a dollar value before the circumstances are reviewed.

Questions with Korey The Lawyer

Real questions.
Let’s talk about them.

Wrongful Death Claims. Start here, then tell me what happened.

Who can bring a wrongful death claim in Texas?

Texas law identifies a surviving spouse, children, and parents as wrongful death beneficiaries. The circumstances and any estate representative’s role still need review. Tell me your relationship to the person who died so we can address the right questions.

Is a wrongful death claim the same as a survival claim?

No. A wrongful death claim concerns eligible family members’ losses. A survival claim preserves a claim the deceased person could have pursued, with estate-related issues to address. The two may arise from the same event but should not be treated as interchangeable.

Can I call if no estate has been opened?

Yes. Tell us what has and has not been done. Whether an estate appointment is needed depends on the claims and circumstances. You do not need to solve that question before requesting a case review.

Does a fatal accident automatically create a wrongful death case?

No. We need facts supporting legal responsibility for the death. The records, witnesses, circumstances, and applicable law matter. A case review helps identify the questions that need investigation.

Does a criminal investigation prevent a civil claim?

Not necessarily. A civil wrongful death claim and a criminal proceeding serve different purposes. A pending investigation may affect the available information, but your family should not assume all civil deadlines stop while it continues.

How much is a wrongful death claim worth?

There is no responsible way to answer that from a headline or another family’s result. The evidence, eligible claims, losses, responsibility, and available recovery sources all matter. Start with the facts and the people involved.

What if an insurance company has already offered money?

Have the offer and proposed release reviewed before signing. We need to understand whose claims it addresses, who has authority to act, and what rights may be given up. Tell us about any deadline the insurer has stated.

How do I speak with Korey about a fatal accident?

Call 1-877-HIT-MEUP!®️ or leave basic contact information below. The initial case review is free. Our office is in Houston, and we serve Texas families. Start with what happened and the questions on your mind.

What if relatives remember different details about the event?

Let each person describe what they actually saw or heard, and identify where their information came from. Do not try to make every account match. Different viewpoints can raise useful questions. Keep witness contact details separate from family recollections so the sources remain clear.

Should we keep receipts for funeral and related expenses?

Yes. Keep invoices, receipts, payment records, and the name of the person who paid each expense. Retain related insurance or benefit correspondence too. Which expenses belong in which claim, and who may pursue them, requires review. Do not assume every family payment is treated the same way.

The insurer wants to settle the vehicle damage. What should we ask?

Ask exactly which claims the proposed document resolves and who is being asked to sign. Keep the offer and complete release, including attachments. A vehicle payment and claims arising from a death require careful distinction. Signing authority and the wording of the agreement should be reviewed together.
