    Call for emergency help if anyone is injured or in danger. Exchange insurance information, keep the report number, and notify your own insurer.

  2. Photograph. Preserve.

    When safe, photograph the vehicles and scene. Save witness contact details and original dashcam footage, including the moments before and after impact.

  3. Understand statement requests.

    Confirm which insurer is asking and what it wants, including requests for records or a signature. Get advice before agreeing to a recorded statement, and understand your own policy’s reporting and cooperation requirements.

The other driver’s insurance company called. What should I say?

Get advice before agreeing to a recorded statement for the other driver’s insurer. First, confirm who is calling, which company they represent, whether the call is being recorded, and what they want. Your own policy may require prompt reporting and cooperation, so do not assume the same requirements apply to both companies.

Who pays my medical bills and missed work?

The other driver’s liability insurance may pay covered medical bills and lost income if that driver is responsible for the crash. Your own insurance may help too. Personal injury protection (PIP) may cover eligible medical bills and lost wages; medical payments or uninsured/underinsured motorist coverage may apply to eligible losses. Keep your bills, treatment records, receipts, and proof of missed work so the available coverage and losses can be reviewed.

Do I need a lawyer if the other driver admitted fault?

Even when the other driver admits fault, you may still have questions about your injuries, medical bills, missed work, insurance coverage, and what a fair settlement should include. A lawyer can help document your losses, review the available coverage, and evaluate an offer before you sign a release. An admission of fault does not answer those questions. Start by finding out what the offer actually settles. Check whether it accounts for your medical bills, missed income, and possible future treatment. What should I do after a crash that wasn’t my fault?

Start with safety and medical care. Call 911 if anyone is hurt or in immediate danger. If no one is injured and the car can be driven safely, move out of traffic. When safe, exchange driver and insurance details, photograph every involved vehicle and the scene, collect witness contacts, and save original dashcam footage—even after a rear-end crash where fault seems obvious. Notify your own insurer and report the claim to the other driver’s insurer. Keep the report and claim numbers, treatment records, bills, receipts, and proof of missed work. If the other insurer refuses payment, ask for a detailed explanation in writing.

Should I get a lawyer, and how do I choose one?

Consider talking with a lawyer if you were hurt, payment is refused, fault is disputed, or an offer or release is unclear. Reviewing what happened, the injuries, and the evidence helps determine whether there is a claim. Ask what the lawyer would do, who would handle your case, how the firm communicates, and what experience it has with wrecks like yours. Read the written fee and expense agreement and have your questions answered before signing.

What is my claim worth, and why can it take time?

The injuries, medical expenses, missed income, responsibility for the crash, and available coverage all matter. A number from someone else’s case is not a promise about yours. Timing can depend on medical information, disputed issues, the number of parties, and whether a lawsuit becomes necessary. A quick offer is not the same as a fully evaluated claim. Ask what remains unresolved and what information would help.

Can I call before I have the crash report or finish treatment?

Yes. Call with what you know. If you have a report number, photos, insurance information, or an adjuster’s letters, have them nearby. You can ask about evidence, documents, and deadlines while treatment continues. Your treating providers should guide medical decisions. Tell us what they have recommended and what remains uncertain, without guessing about care you may need later.

Claim details and different crash situations

How long do I have to file a Texas car accident lawsuit?

Texas generally allows two years after a personal injury claim accrues to file a lawsuit. Exceptions can change the deadline, and claims involving government entities can have earlier notice requirements. Do not assume insurance negotiations protect the filing deadline. Have the dates reviewed promptly.

Can I recover compensation if the crash was partly my fault?

Possibly. Under Texas proportionate responsibility rules, responsibility above 50% bars recovery. At 50% or less, recoverable damages are reduced by your share. A disagreement about fault calls for evidence, including the scene, witness accounts and available recordings.

What if I was a passenger or the crash involved Uber or Lyft?

Tell us which vehicle you were in, who was driving, and whether it was a paid ride or work trip. Responsibility may involve more than one driver. For a rideshare crash, the driver’s activity at the time can affect which insurance applies. Relevant policies and your relationship to the parties need review. Do not assume a passenger must pursue the same claim as the driver.

The crash report has a mistake. What should I do?

Keep a complete copy and identify the specific statement you believe is wrong. Save the records, photos or witness details that may explain the discrepancy. Ask the investigating agency about its correction process. A report is one piece of the evidence, and a disagreement should be addressed factually.

Does settling vehicle damage also settle my injury claim?

Read the actual agreement. A repair or total-loss payment may address different issues from bodily injury, but the scope of any release matters. Keep every page of the offer and release. Before signing, understand which people and claims the language covers.

Which vehicle and injury cases does the firm handle?
