What to Do After a Car Accident in San Antonio
The hours after a wreck decide a lot about your case. Here is the order that protects you.
- Get medical care, even if you feel fine. Adrenaline hides injuries. Neck, back and head injuries often show up a day or two later. University Health’s University Hospital, Methodist Hospital, St. Luke’s Baptist Hospital and any urgent care in Bexar County will create the medical record your case needs. Insurance companies use a gap in treatment to argue you were not really hurt.
- Call 911 and get a police report. If San Antonio Police (SAPD) or the Bexar County Sheriff’s Office investigates a reportable crash, the investigating officer prepares a Texas Peace Officer’s Crash Report (CR-3). You can order a copy from the Texas Department of Transportation online. Ask the officer for the report number.
- Take photos before the cars move. Both vehicles, the damage, the road, skid marks, traffic signals, the other driver’s license plate, license and insurance card.
- Get names and numbers of witnesses. Independent witnesses are the best evidence of fault, and they leave fast.
- Do not give a recorded statement to the other driver’s insurance. You are not required to, and adjusters are trained to get you to say things that cut your claim. Say you will have your lawyer contact them.
- Do not sign anything or accept a quick check. A first offer that arrives in days is a sign the insurer knows the case is worth more.
- Call a San Antonio car accident lawyer. The earlier a lawyer gets involved, the more evidence can be preserved: dash-cam footage, business cameras along the road, the other driver’s phone records and vehicle data.

San Antonio Roads, Collision Types and Common Causes
TxDOT recorded 46,744 reportable motor vehicle crashes in Bexar County in 2025.
San Antonio drivers get hit on roads including:
- Loop 410, especially the interchanges with I-10, I-35 and US-281, where merging traffic and speed combine
- I-35 through downtown and the Northeast Side toward Live Oak and Schertz
- I-10 from downtown to the Medical Center and out toward Boerne
- Loop 1604 on the North Side, where construction zones shift lanes week to week
- US-281 between the airport and Stone Oak
- Culebra Road, Bandera Road, Military Drive and Southwest Military on the West and South Sides, where intersection crashes and red-light collisions are common
The types of crashes we evaluate
- Distracted driving and texting
- Speeding on the loops and highways
- Drunk driving, especially on weekends and after Spurs games and Fiesta
- Running red lights at major intersections
- 18-wheeler and commercial truck crashes on I-10 and I-35
- Rideshare drivers (Uber, Lyft) rushing between fares
- Uninsured and underinsured drivers
Whatever caused your crash, the question is the same: who was at fault, and how do you prove it. That is the job of your lawyer.

Injuries, Treatment and Who Pays Medical Bills
After a wreck, medical care and payment questions often arrive together. Neck and back injuries, fractures, head injuries and other serious trauma can affect daily life long after the vehicles leave the scene. Seek appropriate care and describe new or changing symptoms to a medical professional.
Meanwhile, do not assume the other driver’s liability insurer will pay each provider as bills arrive. Depending on the facts and policies, health insurance, personal injury protection, medical-payments coverage or another payment arrangement may be relevant while a liability claim is investigated. Coverage limits, deductibles, reimbursement rights and outstanding balances need review.
Also, keep bills and explanations of benefits separately from treatment notes. Record missed work and practical limitations, too: lifting your child, driving, sleeping or performing your usual job. Your lawyer can use those records to evaluate losses and potential future care. At the same time, do not interrupt medically recommended treatment just to fit an insurer’s timetable.
How Fault and Insurance Work in Texas
Texas is an at-fault state. The driver who caused the crash, through their insurance, pays for the harm. Three rules shape almost every San Antonio case.
The more-than-50-percent rule
Modified comparative negligence (the 51% rule). You can recover as long as you were not more than 50% at fault, and your recovery is reduced by your share. If you were 20% at fault for a $100,000 case, you recover $80,000. Insurance companies push hard to pin a percentage on you. A lawyer pushes back with the evidence.
Minimum limits and additional coverage
Texas minimum coverage is low. Drivers are only required to carry $30,000 per person and $60,000 per accident in bodily injury coverage, plus $25,000 per accident in property damage coverage (30/60/25). A serious injury blows past that fast. That is why your own uninsured/underinsured motorist (UM/UIM) coverage and personal injury protection (PIP) matter, and why we look at every policy that might apply, not just the other driver’s.
The recorded statement. The other driver’s insurer will call within days, sound friendly, and ask for a recorded statement. You are not required to give one. Anything you say, including “I’m fine,” will be used to lower your claim. Let your lawyer handle every conversation with the insurance company.
When you hire The Huff Law Firm, the calls stop coming to you and start coming to us.

What Is My San Antonio Car Accident Case Worth?
Every case is different. What we can tell you is what you are allowed to recover under Texas law.
| Type of damages | What it covers |
|---|---|
| Medical expenses | ER visit, surgery, imaging, physical therapy, medication, and future care the doctors say you will need |
| Lost wages | Pay you missed while recovering, and reduced earning ability if you cannot return to the same work |
| Pain and suffering | Physical pain and the daily limits an injury puts on your life |
| Mental anguish | Anxiety, fear of driving, sleep problems and trauma after a serious crash |
| Property damage | Repair or replacement of your vehicle and anything in it |
| Physical impairment and disfigurement | Permanent loss of function, scarring |
| Loss of consortium | The effect on your marriage and family |
| Wrongful death | Funeral costs, lost support and companionship when a crash takes a life |
Sources: Texas definitions of economic and noneconomic damages (§ 41.001) and Texas wrongful-death and survival law (Chapter 71). Eligibility and recoverable losses depend on the claim and evidence.
What moves the number: the severity and permanence of the injury, how clear fault is, how much insurance is available, and how well the case is documented from day one. The insurer’s first offer rarely reflects any of that. Our job is to build the file so the full value is on the table.
How Long Do I Have to File a Car Accident Lawsuit in Texas?
Texas generally provides a two-year limitations period for personal-injury lawsuits under Civil Practice and Remedies Code section 16.003. Accrual, exceptions and the type of claim can change the analysis. Do not assume that every deadline is exactly two years from the crash, or that negotiating with an insurer protects the filing deadline.
However, claims involving a government entity can require notice much sooner. San Antonio’s official claims portal quotes a 90-day notice requirement in City Charter section 150. A claim involving a VIA vehicle, another public entity or a government employee requires identifying the proper entity and applicable law; sending a notice to the wrong office can create problems.
Claims involving children, death or other special circumstances also need individual review. Evidence can disappear before any lawsuit deadline: camera footage may be overwritten, vehicles repaired and witnesses harder to locate. Therefore, contact counsel promptly with the date, location and parties involved. Sources: Texas section 16.003 and San Antonio’s notice-of-claim portal.
How Much Does a San Antonio Car Accident Lawyer Cost?
Your case review is free. If we accept your personal injury case and do not recover money for you, you owe our firm no attorney fees and nothing for the case expenses we advanced. If we recover money, attorney fees and case expenses are handled according to your written agreement.
Ask how the attorney-fee percentage works, how expenses are treated and what obligations may affect your net recovery. For example, a settlement amount and the amount a client receives are different figures. Understanding the agreement at the beginning helps you evaluate your choices with clear expectations.
You can call even if you are unsure whether you need representation. A minor property-damage dispute can raise different issues from an injury requiring ongoing treatment. Tell us what happened and what help you need. We will review whether the firm can assist; an initial inquiry alone does not create an attorney-client relationship.
How a San Antonio Car Accident Lawyer Handles Your Claim
No fee unless we win. We work on contingency. The consultation is free, we advance the case costs, and our fee comes out of the recovery. If there is no recovery, you owe nothing.
A lawyer calls you now. The line is open 24 hours a day, seven days a week, and a lawyer can call you back immediately.
We fight like it’s personal. Korey Huff built this firm for people the insurance companies expect to roll over. He takes cases to trial when the offer is wrong, and insurers know it. Recent results: $3,000,000 settlement. $2,000,000 settlement. $1,000,000 settlement. $725,000 settlement. $700,000 commercial car accident settlement. $600,000 and $500,000 settlements. Past results do not guarantee future outcomes; every case is different.
A Black-owned firm you can see yourself in. You will know who your lawyer is from the first call to the last.
We handle every kind of San Antonio crash: rear-end, T-bone and intersection collisions, hit-and-run, drunk-driving wrecks, 18-wheeler and commercial truck accidents, rideshare (Uber and Lyft) accidents, motorcycle crashes, pedestrian and bicycle injuries, and uninsured-driver claims.
- Free case review. You tell us what happened. A lawyer tells you honestly whether there is a case.
- We take over the insurance company. Every call and letter goes through us.
- We build the evidence. Police report, medical records, photos, camera footage, witness statements, expert analysis when the crash needs it.
- We demand full value. A documented demand to every insurer that owes you money.
- We settle or we try the case. Most cases settle. The ones that should go to trial, do.
A San Antonio auto accident lawyer can explain how the evidence affects a claim in Bexar County courts and whether uninsured motorist coverage may apply. Lawyers handle your case and discuss the next step with you.
Korey’s three steps after a car accident
Read the next-steps guide.
Establishing fault after a car crash
A claim generally requires evidence of negligence and resulting harm. Crash reports, photographs, witness accounts, video, vehicle damage, and medical records can help explain what happened. A ticket or an admission does not settle every issue.
Dealing with the insurance company
Keep correspondence and claim numbers. Before giving the other driver’s insurer a recorded statement or signing a release, understand what is being requested. Your own policy may require timely notice and cooperation. Bring the policy and any settlement documents to your review.
Protecting your filing deadline
Texas generally gives a person two years from the date a personal injury cause of action accrues to file suit. Exceptions, special claims, and notice requirements can change the analysis. Don’t assume insurance negotiations extend your deadline. Ask the firm to evaluate the dates that apply to your situation.

San Antonio Car Accident Lawyer FAQ
How much does a car accident lawyer cost in San Antonio?
Nothing up front. The Huff Law Firm works on contingency: the consultation is free and the fee is a percentage of what we recover for you. If we do not win, you do not pay a fee.
Is it worth getting a lawyer after a car accident in San Antonio?
A lawyer can investigate fault, evaluate coverage and damages, and handle the legal claim. Whether representation makes sense depends on the injury and dispute; a free review helps you understand the issues without promising a larger payout.
What should I not say after a car accident?
Do not say “I’m sorry,” “I’m fine,” or guess at how fast you were going. Do not give a recorded statement to the other driver’s insurance company. Give the facts to the police and let your lawyer handle the insurers.
How long does a car accident settlement take in Texas?
Timing depends on treatment, the medical outlook, fault, available insurance and negotiations. Litigation can add stages, so a meaningful estimate requires reviewing the actual case rather than promising a fixed number of months.
How long do I have to file a car accident lawsuit in Texas?
The general personal-injury limitations period is two years, subject to accrual rules and exceptions. Government claims can require earlier notice, including a 90-day city notice requirement in San Antonio; get advice promptly.
What if the other driver has no insurance?
You may still have a claim through your own uninsured/underinsured motorist (UM/UIM) coverage, which Texas insurers must offer. We review your own policy in every case for this reason.
What if I was partly at fault?
You can still recover as long as you were not more than 50% at fault. Your recovery is reduced by your percentage of fault. Insurers try to inflate your share, which is one of the main reasons to have a lawyer.
Should I seek medical care if symptoms start after the wreck?
Seek appropriate medical advice and tell the provider when symptoms began and how the collision happened. Keep records of symptoms and treatment; a lawyer does not replace medical evaluation.
Can I get my car fixed while my injury claim is pending?
Yes. Property damage is usually handled separately and faster than the injury claim. We help you get the repair or total-loss payment moving right away.
Where is Korey Huff’s office, and do I have to visit?
The Huff Law Firm is based in Houston and represents clients throughout San Antonio and Bexar County. You do not have to come in. We handle cases by phone, video and in person when needed, and we come to you if you are hospitalized.
We also handle other injury matters
Car accidents are one part of the firm’s personal injury practice. We also evaluate serious-injury, wrongful-death and premises-liability matters. Call to discuss the type of injury and whether the firm can help.
